        <title>Maui County Council Housing &amp; Land Use Committee: Bill 9 Temporary Investigative Group Report</title>

The Maui County Council's Housing and Land Use Committee formed a Temporary Investigative Group (TIG) to assess the feasibility and economic impacts of Bill 9. 


Bill 9 was proposed by Maui's Mayor in 2024 and aims to create affordable housing by phasing out Short Term Rentals in the Apartment Zones.  If implemented as written, the Bill would phase out short-term rentals in more than 7000 properties across Maui County.


It's important to understand that the TIG is not tasked with making recommendations to alter Bill 9, but rather proposes other legislation, policy and zoning changes that the County should implement. 


Maui, like many places across the world, is facing a housing crisis, which was exacerbated by the tragic Lahaina Fires.  The Mayor said the goal of the legislation was to create affordable housing, and the mechanism by which this would happen has been widely and passionately debated by community members. Read the history of Bill 9.


The TIG met with owners in the Apartment District, the Planning and Zoning Departments, and made site visits.  The TIG evaluated the economic impact to the County as it relates to not only property taxes, but also GET and TAT taxes, as well as impacts on tourism and jobs related to tourism.  Issues such as sea level rise and limited water resources were considered, as well as financial viability (for example, properties with pending ligitation would likely be limited to cash buyers only). Read the Maui County Council HLU TIG Report


Per the Report, the &quot;TIG was requested to




Identify Apartment District properties on which TVR uses should be allowed to continue and recommend the appropriate land-use-designation changes:


Identify, and rank in order of importance, changes to Chapter 19.510, Maui County Code, to improve application and review processes;


Identify which beneficial changes to policies and procedures require legislative proposals and action by the Council; and


Identify which beneficial policies and procedures can be accomplished by Department of Planning administrative action.




The TIG recommends:


1.  The Department of Planning introduce legislation establishing H-3 and H-4 Hotel Districts.  These Districts could be like-for-like with A-1 and A-2 Apartment Districts and those properties on which TVR uses should be allowed to continue could then be rezoned into the H-3 and H-4 Districts without changing the properties' allowable uses.


2.  Council-initiated land-use designation changes


The scope of this would be identifying Apartment District properties where continuing TVRs may be appropriate, suggest Council-initiated bills to approve a change in Zoning, Community Plan Amendment, or Conditional Permit for the identified properties.


The Report provided an attached Exhibit 2, which is sorted below Alphabetically by Districts/Areas.  This identified properties where there are existing rentals where continued TVR uses may be appropriate.  These are properties where the  market values that are not compatible with affordable housing, that are located entirely in the sea level rise area, and those that are comprised mostly of timeshare. 


Notably absent in the  are properties in designated resort areas per the community plan such as the Kapalua Golf Villas and Kapalua Ridge Villas, and also others where monthly maintenance fee, special assessment, and/or lease rent costs may exceed affordable housing guidelines


The report notes that &quot;Owners of property not included in Exhibit “2” who are wishing to continue TVR uses may still individually apply for land-usedesignation changes.&quot; 


Further it notes: &quot;Owners of properties that are listed in Exhibit “2” but prefer to apply for upzoning of their properties may be excluded from Council-initiated comprehensive zoning and individually apply for land-use-designation changes.&quot;

While the record high sale was in 2021, the average sales price did increase at Montage as did the average sales price/sq. ft.  It is noteworthy that the high sale in 2021 was a four bedroom residence.  With only eight ever built, these seldom come up, but when they do sell, they command a high price that does impact the average sales price and price per sq. ft. as they are directly oceanfront residences that often command a higher price.  The number of sales was similar to 2020, but the volume was significantly higher.

Each month, the Realtor's Association of Maui publishes updates on the Maui real estate market.  The report notes


&quot;New Listings decreased 39.3 percent for Single Family homes and 52.7 percent for Condominium homes.Pending Sales decreased 30.7 percent for Single Family homes and 36.0 percent for Condominium homes.Inventory increased 7.8 percent for Single Family homes and 9.7 percent for Condominium homes.Median Sales Price increased 3.0 percent to $1,025,000 for Single Family homes and 9.7 percent to $800,000 for Condominium homes. Days on Market increased 10.7 percent for Single Family homes but decreased 31.5 percent for Condominium homes. Months Supply of Inventory increased 45.0 percent for Single Family homes and 50.0 percent for Condominium homes.


Affordability challenges have priced many buyers out of the market this year, and buyers who do succeed in purchasing a home are finding that the costs of homeownership have increased significantly, with monthly mortgage payments more than 55 higher than a year ago, according to the National Association of REALTORS®. Inventory remains lower than normal, and as the market continue to shift, experts project homes will begin to spend more days on market and price growth will slow in the months ahead.&quot;


It seems as if the frenzy of 2021 is behind us, though locations with great views in excellent condition are still commanding the interest of buyers. The South Maui resorts of Wailea and Makena continue to command the highest condominium sales prices, though the Montage Residences, Kapalua Bay are not far behind.


MAUI HOMES: ACTIVE LISTINGS, PENDING SALES, AND SALES*


Active Listings: 221 homes from $590,000 in Upcountry Maui to $35,000,000 for an oceanfront home for sale in MakenaPending: 137 homes from $390,000 Leasehold in Kula to $35,000,000 for an estate in One Palau'ea Bay in MakenaSold: 788 homes from $230,000 in Wailuku to $26,490,000 for an estate across the street from the water in Makena.  This compares with 2021 where the high sale was $78,000,000, paid by Jeff Bezos in an off market deal which is reported to also include corporate holdings.  Prior to that, the high sale for 2021 was $45,000,000 for a home at Keawakapu Beach.


MAUI CONDOS: ACTIVE LISTINGS, PENDING SALES, AND SALES

The Vintage at Kaanapali is a popular resort community in the heart of the Kaanapali Resort.  





The Market at the Vintage: A Five-Year Perspective


The Vintage has been a popular choice for Maui buyers with approximately 15 of the total residences trading since 2020.  At the writing of this post, there are no active listings at the Vintage and only two sales to record in MLS in 2022.  The average sales price year to date is up +15 over 2021 and the high sales price is up 23.  


It's noteworthy with only two sales this year, the stats can be a bit confusing.  


Vintage 104 sold at 92 of asking at $1,200,000 after 496 days on the market.  This is a two-story cottage, unfurnished, with slightly obstructed views overlooking other buildings.Vintage 169 sold at 100 of asking at $1,995,000 with only 52 days on the market.  This was a single-story cottage, with great views and sold turn-key.

Paki Maui is an oceanfront resort condominium property located at the north end of Kaanapali, approximately five miles north of Lahaina town. Paki Maui is on Maui County’s Minatoya List of properties that allow short-term nightly vacation rentals. The onsite rental management company is operated by Castle Resorts. There are also many independently managed units at Paki Maui.  


Paki Maui has photovoltaic solar panels installed on the roof to minimize electric costs to the owners.  All the utilities have been included in the monthly HOA fees in the past, though Paki Maui just completed submetering for each unit, and going forward, electric will be billed separately by unit.

Newly listed at $779,000, Paki Maui 206 is one of the premium ocean view locations with 2 oceanfront lanais, and views from both the living room and master bedroom.  It has been maintained as a second home and enjoyed for many years by the original owner and family, who purchased it in 1976.  The unit has 2 bedrooms and 2 baths, with a total of 796 interior square feet and an additional 193 square feet of lanai, for a total of 989 square feet. The Master Bedroom has a walk-in closet. Laundry rooms are maintained by the association, and the laundry is located just down the hall on the same floor. Montage Residences at Kapalua BayWhole Ownership Condominium Residences


When originally developed as a Ritz-Carlton Club and Residences in 2008, the property was comprised of 84 wholly-owned three and four-bedroom residences, some of the largest condominiums available in West Maui.  These residences are located in buildings 1, 2, 5 and 6 and ranged from 2,789 to 4,055 sq. ft. 


The development also included 62 smaller two and three-bedroom residences that were offered as 1/12 ownership located in buildings 3 and 4.  Since then, the property was re-branded in 2014 and all developer fractional sales were halted. 


Since being rebranded the Montage Residence Kapalua Bay in 2014, sales at the property have soared.  As an overview, when sales at the property first launched in 2009, the market was at a downturn after it's 2007/2008 peak. The low for the Kapalua Resort real estate market took place after in 2012.  


To give you a better sense of how significantly the market has changed, between 2009-2011 there were 14 sales averaging approximately $3.83M, with a total sales volume of $53,747,552.  The foreclosure took place in 2011, and sales ceased while improvements were made property-wide.  When sales began again, the building 1 which is oceanfront, saw the bulk of the activity, followed by buildings 5 (particularly upper floors) and 2.  This summer, the developer began sales of 15 of the smaller three-bedroom residences (approximately 2,000 +/- sq. ft.) in buildings 3 and 4, as well as the remaining inventory of larger residences in building 6.


As of the date of this post, there have been 16 Residences to sell at the Montage Kapalua Bay, averaging $4.53M and a Year to Date volume of $69,855,000 with another $9,240,000 in pending sales in MLS.  This represents a dramatic 19 increase over 2018's total sales volume and a 49 increase over the sales volume when the project relaunched in 2014.   It is noteworthy that 2019 also marks a year of remarkable resale activity, with prime locations with outstanding furnishings, such as Residence 1405, commanding the highest resale of a 3 Bedroom Residence in the project's history:

Comments on Montage Residences Kapalua Bay Condo Sales History (Year over Year):


It is to expected that the days on market would increase, as we start to see more re-sales introduced to the market in 2019.  Additionally, the low sales price would have been at it's peak in 2014, when buyers were focused on the two oceanfront buildings (buildings 1 and 2) and at its lowest in 2019 with the introduction of the 15 smaller residences in buildings 3 and 4. 


You'll also note a variation in the high sales--there are only 8 four-bedroom residences, which are located at the center of the two oceanfront buildings.  These command the highest sales prices for both their size and location.   There were three four-bedroom sales in 2014, which served to also increase the average SP/Sq. Ft., one in 2016, two in 2018, and one in 2019.  This is why you see lower High Sales Prices in 2015 and 2017.

Mahana Market Update and New Listings

Currently there are two pending/ under contract units at the Mahana – an eleventh-floor studio listed at $695,000, and a second-floor 1 bedroom 1 bath, listed at $821,000.


Days on market at the Mahana is down significantly in 2019 compared to the past two years,  2017 and 2018.

        <title>The Kapalua Bay Course: New Pro-Shop and Reconfigured Course</title>

The newly reconfigured Kapalua Bay Course opens in its new location at the Kapalua Village Center


The new Kapalua Bay Course Pro Shop opens today at the Village Center next to Taverna Restaurant.  In addition to proximity to great Italian food, the new location provides increased retail offerings, a complete grass driving range, 2 large practice putting greens and is located right below the Kapalua Golf Academy.





This relocation will provide the Bay Course with a complete grass driving range ( no more limited distance balls) and 2 large practice putting greens.  Additionally, the retail offerings at the Bay Course should be able to offer more merchandise selections with the increased square footage of this location.  


The Bay Course opened in 1975 and has become one of Maui's favorite courses for visitors and locals alike for its relaxed play and beautiful views.  The 18 hole, par 72 course has been home to over 20 major championships, including the Kapalua Invitational and the Kapalua LPGA Classic.  Now under management by Troon, the following changes will accompany the move to a new location in the center of the resort: 




The 1st hole on the Bay Course will now be what was previously the 7th hole (the Par 4 dogleg to the right up to an elevated green just below the Ridge Villas)


A brand new cart path has been built to take golfers from the Golf check-in at the Village Center to this new 1st hole.


All holes will progress forward from there, with old 8th hole repositioned as the 2nd hole.


The Iconic oceanfront 5th hole, where you tee off and shoot across the water, will now become the 17th hole


The new 18th Hole will be the Par 5 of old 6th next to Office Road, allowing everyone to finish up at the New 19th hole at Taverna :)


The old guest service area tunnel just below the old Bay Pro Shop is scheduled to be updated to offer expanded guest services.  You can pick up extra towels, tees, tee marker, etc.


The plan is to eventually offer a casual food and beverage selection at this guest service station.




For communities situated along the course, these are the changes:




Ironwoods: the Ironwoods will now look over the 16th and 17th holes


Kapalua Golf Villas: the Golf Villas will now be situated on the 4th and 5th holes, with views overlooking the 12th hole as well.


Kapalua Ridge Villas: the Ridge villas will now be situated along the 1st, 13th, 14th, and 15th holes, with views across the 18th hole


Pineapple Hill and Pineapple Hill Estates: these residential communities will now be situated along the 6th and 7th holes
